Warranty Statement
Kimberley Products Pty Ltd (ABN 34 004 518 012) (“Kimberley Products”) warrants that its goods will be free from defects in materials and workmanship for 12 months from the purchase date (“Warranty Period”).
Kimberley Products will in its discretion, repair or replace any goods, or any part of the goods, found to be defective during the Warranty Period at its cost.
The replacement or repair of the goods, or part of the goods, is the absolute limit of Kimberley Products’ liability under this warranty.
This warranty will not apply where: (A) The buyer has failed to install, use or maintain the goods in accordance with Kimberley Products’ specifications or instructions; (B) The buyer has misused, modified or overloaded the goods; (C) The defect has arisen due to abuse, neglect or accident.
To make a claim under this warranty, the buyer must contact Kimberley Products, show proof of purchase and, if required, return the goods to Kimberley Products at the buyer’s cost.
The claim will then be assessed and processed accordingly. Where Kimberley Products cannot find any defect in the goods, the buyer must pay Kimberley Products’ costs of evaluation, inspection and testing.
Kimberley Products make no express warranties or representations other than set out in this warranty.
The benefits of this warranty only apply to the initial buyer and are not transferrable. The benefits of this warranty are in addition to any rights and remedies imposed by Australian State and Federal legislation that cannot be excluded.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
